Today's (4/21) AOPA ePilot has a very good article on the case. It's possible that the case could make it all the way to SCOTUS. Whether or nor not they would consider it is a different matter. FAA Alaska region actually put out a pamphlet recommending a low level pass to check conditions. In court FAA lawyer said that it is advisory in nature and doesn't affect regulation.
